# WhatsApp Opt-In: How to Collect Consent Without Risking Your Number

 22 de October, 2026

*Last updated: October 21, 2026*

Most WhatsApp programs do not fail because the copy is weak or the timing is off. They fail because the list was built on shaky permission. Contacts who never asked to hear from you report or block your number, quality drops, and your sending limits shrink right when a campaign needs them. Opt-in is the cheapest insurance you can buy for a channel that now carries real revenue.

This guide explains what counts as valid WhatsApp opt-in, how B2B teams collect it without friction, how to keep proof of it, and how to handle opt-outs so your account stays healthy. If you are still deciding how to use the channel, start with our [guide to AI agents on WhatsApp Business](https://blog.getdarwin.ai/en/ai-agents-whatsapp-business-guide-2026?hsLang=en) and come back here before you send your first outbound message.

**Key takeaway:** A customer messaging you opens a reply window, not a permanent permission. Anything you initiate outside that window needs a clear, recorded opt-in that names your business and says what you will send.

## What counts as a valid WhatsApp opt-in

WhatsApp's own [Business Messaging Policy](https://business.whatsapp.com/policy) is short on this point: you may contact someone on WhatsApp only if they gave you their mobile number and gave you permission to message them there. You choose how to collect it, and you remain responsible for meeting the notice and permission rules of the laws that apply to you.

### The three elements of a solid opt-in

Meta's rules leave room for judgment, but in practice a defensible opt-in has three parts. First, it names your business, so the person knows who will be writing. Second, it says what kind of messages to expect, for example appointment reminders, order updates, or product offers. Third, it is a deliberate action, such as ticking an unchecked box or replying "yes", never a pre-ticked box buried in terms and conditions.

One useful change: since November 2024, Meta no longer requires the opt-in to mention WhatsApp by name, according to [CM.com's summary of the policy](https://www.cm.com/blog/whatsapp-opt-in/). The same source still recommends naming WhatsApp, and notes that GDPR expects consent to be specific and informed, so naming the channel remains the safer habit.

### Consent per message category

The policy's best practice is to get opt-in for each message category, and a separate opt-in for calls. [Salesforce's Trailhead module on WhatsApp consent](https://trailhead.salesforce.com/content/learn/modules/conversational-marketing-with-whatsapp/manage-customer-consent) makes the same point and suggests storing one consent column per category, so you can filter a segment by what each contact actually agreed to. Someone who agreed to delivery updates has not agreed to promotions.

## Where to collect opt-in in a B2B funnel

B2B teams have an advantage consumer brands lack: they already collect phone numbers through forms, demos, and sales conversations. The work is adding a clear consent step at each of those touchpoints. The table below maps common collection points to what each needs to be valid.

| Collection point | What makes it valid | Common mistake |
| --- | --- | --- |
| Website or landing-page form | Unchecked box next to the WhatsApp name, plain description of what you will send | Pre-ticked box or consent hidden in the privacy policy |
| Demo or webinar registration | Separate optional field for WhatsApp follow-up | Treating event registration as permission for sales messages |
| Email or SMS invitation | A message asking whether they want updates on WhatsApp, with a clear yes action | Skipping the question and just adding the number to a list |
| Click-to-WhatsApp ad or QR code | The person starts the chat, then you confirm they want future updates | Assuming the first inbound message covers later outreach |
| Sales call or in-person meeting | Verbal or written agreement, logged in the CRM the same day | No record that it happened |

CM.com's list of accepted methods also includes opt-ins collected on another channel, which can count for WhatsApp, and opt-in inside an active WhatsApp conversation. It is explicit on one trap: a customer sending you a message is not an opt-in. Replies are allowed inside the customer care window, but business-initiated messages outside it need prior permission.

If your outreach starts with a lead-qualification conversation, build the consent question into the first exchange. Our walkthrough on [automating lead qualification on WhatsApp](https://blog.getdarwin.ai/en/automate-lead-qualification-whatsapp-ai?hsLang=en) shows where that question fits without slowing the conversation.

## How to record and prove consent

Collecting opt-in is only half the job. If Meta reviews your account or a regulator asks, you need evidence. [ChatDaddy's compliance guide](https://chatdaddy.tech/blog/whatsapp-compliance-guide) recommends storing four things for every contact: the date of opt-in, the source (web form, event, in-store), the exact wording the person saw, and their identifier.

### Retention and ownership

The same guide suggests keeping marketing opt-in records for the duration of the relationship plus three years, and keeping opt-out records permanently, so you can always show that a request was honored. Treat that as a conservative internal standard and confirm the right period with your legal counsel.

Store consent in the system your sales and support tools read from, normally the CRM. A consent field living in a spreadsheet nobody checks before a send is the most common reason teams message people who said no.

**Example:** A SaaS team captures a demo request with an optional WhatsApp box. The CRM stores the timestamp, the form name, and the sentence shown on the form. Six months later a contact disputes receiving messages, and the team answers in minutes by pulling a single record instead of reconstructing the history.

## Handling opt-outs the right way

The policy states that businesses must honor requests to block, stop, or opt out of messages, whether the request happens on WhatsApp or somewhere else. That includes a request made by email or phone.

For marketing templates, Meta provides built-in stop and resume buttons. For utility messages such as delivery or appointment updates there is no built-in option, so you manage it yourself. CM.com recommends four habits: explain how to stop in your WhatsApp business profile, confirm a "STOP" reply right away, sync opt-outs into your CRM immediately, and update your privacy statement to name WhatsApp and describe the options.

[ChatDaddy's pre-campaign checklist](https://chatdaddy.tech/blog/whatsapp-compliance-guide) goes further and suggests processing opt-out requests within 24 hours. Faster is better: the person who asked to stop and still gets a message is the one most likely to hit the report button, and reports weigh heavily on quality. The [Business Messaging Policy](https://business.whatsapp.com/policy) warns that a sustained low quality tier can limit your message and call volume.

### Why the penalty is bigger than the channel

Platform enforcement is only one risk. Where GDPR applies, ChatDaddy's guide notes that marketing needs explicit consent and, per the [same source](https://chatdaddy.tech/blog/whatsapp-compliance-guide), fines can reach 4% of global annual turnover. If you operate in Latin America, Europe, or both, your consent flow is also a legal record, which is why it deserves the same care as your [voice outreach compliance](https://blog.getdarwin.ai/en/tcpa-ai-voice-agents-compliance-b2b-outbound?hsLang=en).

## The 24-hour window and template messages

Consent decides whether you may message someone. The 24-hour window decides how. According to the [WhatsApp policy](https://business.whatsapp.com/policy), businesses can start a conversation only with an approved message template, and can reply without a template only within 24 hours of the user's last message. Outside that window, only approved templates are allowed.

### What this means for a B2B sequence

Plan your first outbound touch as a template, written so it earns a reply. A reply reopens the window and lets the conversation continue in natural language. If the lead goes quiet, the next message outside the window is again a template, and again it must stay inside what they opted in to receive. A template that suddenly pitches a product to someone who only opted in to meeting reminders is exactly the kind of mismatch that produces blocks.

## Where AI agents help (and where they must stop)

Automation is where opt-in discipline pays off or collapses. An AI agent that answers inbound chats, qualifies leads, and books meetings can only be trusted if it checks consent status before it sends anything proactive. Teams running outbound prospecting with [Bruno, Darwin AI's outbound sales agent](https://www.getdarwin.ai/en/worker/bruno) typically wire the consent field into the agent's logic, so it never contacts a number without a valid, recorded permission.

The policy also expects automated conversations to offer a way out. Automated replies are allowed inside the 24-hour window, but businesses must provide escalation paths, and the [WhatsApp policy](https://business.whatsapp.com/policy) lists six: transfer to a human in chat, a phone number, an email, web support, an in-store visit, or a support form. Any agent you deploy should offer at least one without friction. We cover the design of that moment in our piece on [AI-to-human handoff and escalation](https://blog.getdarwin.ai/en/ai-human-handoff-customer-service-escalation-2026?hsLang=en).

## A pre-launch consent checklist

Before any outbound WhatsApp campaign goes live, confirm the following with whoever owns your CRM and your messaging platform:

- Every contact on the list has a recorded opt-in with date, source, and the wording shown.
- Consent is stored per message category, and templates map to those categories.
- Opt-out replies such as "STOP" are confirmed instantly and written back to the CRM.
- Your WhatsApp business profile explains how to stop messages and how to reach a human.
- Your privacy statement names WhatsApp and describes how consent works.
- Your AI agent checks consent status before it sends any message outside the 24-hour window.

Teams that run abandoned-cart or reactivation flows should apply the same checks. Our [WhatsApp abandoned-cart recovery playbook](https://blog.getdarwin.ai/en/whatsapp-abandoned-cart-recovery-ai-playbook?hsLang=en) is a good example of a flow where consent wording decides whether the follow-up is welcome or reported.

## Frequently asked questions

### Does a customer messaging me first count as opt-in?

No. According to [CM.com's summary of Meta's rules](https://www.cm.com/blog/whatsapp-opt-in/), a customer sending you a message is not an opt-in. It lets you reply inside the 24-hour customer care window, but business-initiated messages outside it need prior permission.

### Can I reuse an opt-in collected on email or SMS?

Yes, if it clearly covered WhatsApp. CM.com notes that an opt-in collected on another messaging channel can count for WhatsApp, provided the person agreed to receive messages from your business there and you kept a record of it.

### How long should I keep consent records?

[ChatDaddy](https://chatdaddy.tech/blog/whatsapp-compliance-guide) recommends keeping marketing opt-in records for the duration of the relationship plus three years, and opt-out records permanently. Confirm the exact period with your legal counsel, since requirements vary by country.

### What happens if people report my messages?

Reports and blocks affect your quality rating. The [WhatsApp Business Messaging Policy](https://business.whatsapp.com/policy) says that if quality stays low for a sustained period, your message and call volume may be limited, and enforcement can include limiting or removing access.

**Reach more buyers on WhatsApp, with consent built in.**

Darwin AI's outbound agent works from your recorded opt-ins and books meetings while your team sleeps.
